General Terms and Conditions
Updated: 13 August 2026 · Version 2026-08-13
§ 1 Scope
These Terms and Conditions apply to the use of the FundingOS software provided by System Error MM GmbH, Lehrter Straße 49, 10557 Berlin (the “Provider”), by businesses, associations and organisations (the “Customer”). By registering, the Customer confirms that it is acting in the course of its commercial, independent professional or statutory activities (§ 14 BGB). The service is not offered to consumers (§ 13 BGB).
§ 2 Nature of the service
FundingOS is a software tool for finding, understanding and preparing applications for public funding. Content generated by the software consists of AI-generated initial drafts and expressly does not constitute legal, tax or funding advice. No warranty is given as to eligibility for funding or the award of funding.
§ 3 Contract formation, plans and free offer
The contract is formed when registration is completed and the email address is confirmed. FundingOS is offered on a free entry-level plan (“Discover” / “Entdecken”) and on paid plans; the scope of services and prices are set out in the price overview (German original). Prices are exclusive of statutory VAT.
§ 4 Term and cancellation
Depending on the selected billing period, subscriptions run monthly or annually and may be cancelled at the end of the relevant billing period. The right to terminate for cause remains unaffected.
§ 4a Free “Discover” plan
(1) The “Discover” plan includes creating an organisation profile, viewing up to three funding matches, one (1) AI-generated initial application draft, and deadline views. The free plan carries no entitlement to availability, support or any particular scope of functionality.
(2) The Provider may change or discontinue the free plan on 30 days’ notice. Notice will be sent by email to the address on file. The Customer may close the account at any time without notice.
(3) Where FundingOS processes personal data on the Customer’s behalf, the versioned Data Processing Agreement under Art. 28 GDPR, available at the data processing agreement (German original), forms part of the contract. The technical and organisational measures and the list of subprocessors published there form part of that version.
§ 5 Customer obligations
The Customer is responsible for the accuracy of the data it enters and for reviewing the content of generated drafts before submitting them.
§ 6 Advisory services
Separately commissioned advisory services are charged according to the work performed. No success fee contingent on the award of funding is agreed.
§ 7 Liability
The Provider is liable without limitation for intent and gross negligence and under the Product Liability Act. In cases of ordinary negligence, the Provider is liable only for breach of material contractual obligations (cardinal obligations), and liability is limited to loss foreseeable and typical for the contract.
§ 8 Final provisions
German law applies. Where legally permissible, the place of jurisdiction is Berlin, where the Provider is based. If any provision is invalid, the remainder of the contract remains effective.
